Sales conditions
Parthenope Casa d’Aste
acts as an intermediary for the sale of items entrusted by the principals, acting in their name and on their behalf, as required by the documents registered with the Naples VAT Office. The effects of the sale fall exclusively on the Seller and the Buyer, without the Auction House assuming any liability beyond that arising from the mandate received.
The buyer is required to pay an amount equal to 24% of the hammer price, including VAT, for each lot. Full payment of the hammer price, including the buyer's premium, must be made no later than 5 days after the sale, unless the Auction House requests immediate payment
Sales are made to the highest bidder. Transfers of sold lots to third parties are not permitted, and the successful bidder will be solely responsible for payment. Any participation on behalf of third parties must be communicated and approved in advance.
The prices in the catalog are purely indicative and expressed in euros. The descriptions provided represent an opinion and are purely indicative and therefore do not imply any liability on the part of Parthenope Casa D'Aste.
Before the auction, there will be a viewing of the lots, during which the auction director will be available to provide clarifications, verify the condition of the items, and highlight any inaccuracies. Any complaints regarding the non-authenticity of an item must be submitted in writing within 15 days of purchase. If the non-authenticity is definitively determined, the amount paid will be refunded, with no further claims for damages or expenses.
Parthenope Casa d’Aste accepts written and telephone bids with specific authorization. Lots will be awarded at the lowest possible price, subject to any reserves. While the Auction House operates with the utmost diligence, it assumes no responsibility for any errors in the execution of bids. Requests to participate by telephone must be submitted in writing prior to the auction.
Lots are awarded by the auction director. In the event of disputes, the lot will be re-auctioned during the same auction. Bids in the auction room prevail over written or telephone bids.
Purchased lots must be collected immediately after payment. Otherwise, the Auction House reserves the right to charge a weekly storage fee of €26.00, relieving itself of all responsibility for the storage and deterioration of the items.
Buyers are required to comply with applicable regulations, including those regarding the notification and export of cultural goods. The export of goods is regulated by Law No. 1089/1939, Legislative Decree of January 22, 2004, and EEC Regulation No. 3911/92, as amended. Parthenope Casa d’Aste does not guarantee the issuance of the necessary export permits, nor does it assume responsibility for any restrictions. If the State exercises its right of pre-emption, the buyer will not be entitled to any refunds or compensation.
Participation in the auction implies automatic acceptance of these Conditions of Sale. For any disputes, the competent court is that of Torre Annunziata.
