Parthenope Casa d’Aste is authorized to sell the items entrusted to it in the name and on behalf of the principals, as per the documents registered with the Naples VAT Office. The effects of the sale directly affect the Seller and the Buyer, without Parthenope Casa d’Aste assuming any liability beyond that arising from the mandate received.
The buyer will pay a total VAT amount for each lot, equal to 24% .
Sales are made to the highest bidder. Transfers of sold lots to third parties are not accepted. Parthenope Casa d'Aste will hold the winning bidder solely responsible for payment. Therefore, participation in the auction on behalf of third parties must be communicated in advance.
The prices in the catalog are purely indicative and expressed in Euro. The descriptions provided represent an opinion and are purely indicative and therefore do not imply any liability on the part of Parthenope Casa d’Aste.
The auction will be preceded by an exhibition, during which the auction director will be available to answer any questions. The exhibition is intended to examine the condition and quality of the items, as well as clarify any errors or inaccuracies. The catalogue has been compiled with the utmost care and diligence; however, all obligations and responsibilities arising therefrom expire within fifteen days. Any complaints must be submitted in writing once the item's non-authenticity is definitively recognized. The buyer will be refunded the amount paid at the auction. Any claims for damages, refunds, and expenses are therefore excluded, as the Auction House acts as agent on behalf of each consignor. Therefore, for the purposes of the sale, the Auction House assumes only the liability towards buyers arising from its aforementioned capacity as agent.
Parthenope Casa d’Aste may accept purchase orders (written and telephone bids) for lots for sale by specific authorization, for those unable to attend the sale. Lots will always be purchased at the best price allowed by other offers on the same lots and by the registered reserve. Although Parthenope Casa d’Aste will use the utmost care, it is not responsible for any errors that may occur during the execution of bids (written or telephone). When completing the appropriate form, bidders are asked to carefully check the lot numbers, descriptions, and prices indicated. Purchase orders with unlimited bids will not be accepted. Requests to participate by telephone will only be accepted if made in writing before the sale. In the event of two identical written bids for the same lot, the one received first will prevail.
During the auction the Auctioneer has the right to combine or separate the lots.
Lots are awarded by the auction director; in the event of disputes, the disputed lot is put back up for auction during the same session based on the last bid received. The bid placed in the auction room always takes precedence over the buyer's premium referred to in point 6.
Parthenope Casa D'Aste may immediately demand payment of the hammer price and auction fees; in any case, payment must be made no later than 5 days after the sale.
Purchased and paid for lots must be collected immediately. Otherwise, Parthenope Casa D'Aste will retain all storage fees and will be exempt from any liability for storage and any deterioration of the items. The weekly storage fee is € 26.00.
Buyers are required to comply with all applicable laws and regulations regarding the notified items, with particular reference to Law No. 1089 of June 1, 1939. The export of items is governed by the aforementioned legislation and by applicable customs and tax laws. Parthenope Casa D'Aste declines all liability to buyers regarding any restrictions on the export of the awarded lots. Should the Italian State exercise its right of pre-emption, the successful bidder will not be entitled to any reimbursement or compensation from Parthenope Casa D'Aste or the Seller.
The Legislative Decree of January 22, 2004, regulates the export of Cultural Heritage outside the territory of the Italian Republic, while exports outside the European Community are also subject to the provisions of EEC Regulation No. 3911/92 of December 9, 1992, as amended by EEC Regulation No. 2469/96 of December 16, 1996, and by EEC Regulation No. 974/01 of May 14, 2001. Parthenope Casa D'Aste is not responsible for issuing the required permits, nor can it guarantee their issuance. Failure to obtain the aforementioned authorizations cannot justify cancellation of the purchase or non-payment. Please note that archaeological finds of Italian origin cannot be exported.
These rules are automatically accepted by all bidders at the auction. All disputes will be subject to the jurisdiction of the Court of Torre Annunziata.
